Agency workers regulations

The Government has now published  guidance to accompany the Agency Workers Regulations that comes into force on 1 October of this year.

The Regulations bring in the EU's directive on temporary agency work The main change, as far as businesses are concerned, is the requirement to provide agency workers with equal treatment in comparison to 'normal' workers in areas such as pay and basic terms after 12 weeks service.

It's worth noting that the Regulations contain anti-avoidance provisions to stop employers circumventing the law by moving workers from one job to another or by ending and then re-employing workers in an attempt to beat the 12 weeks service rule.
