Do you have a cross border dispute? If so, then the EU's Mediation Directive, which was recently implemented in the UK may be able to assist with disputes that arose on or after 20 May.
The directive, which has been partially implemented in the UK, covers five key areas:
- Ensuring quality of mediation
- Going to mediation with the courts invitation
- Enforcing agreements that follow from mediation
- Confidentiality
- Ensuring that claims aren't affected by the passing of periods of limitation
